Zaksimi Terms of Service
Version 1.0·Effective [Effective Date]
This English version is provided for convenience. If there is any difference between the Korean and English versions, the Korean version prevails.
Zaksimi Terms of Service
Chapter 1. General Provisions
Article 1 (Purpose)
These Terms set out the rights, obligations and responsibilities of BTiwoom Co., Ltd. (the "Company") and members, and other necessary matters, regarding the use of the Zaksimi mobile application, the related website (zaksimi.com) and all related services (the "Service").
Article 2 (Definitions)
The terms used in these Terms have the following meanings.
- "Member" means a person who agrees to these Terms, enters into a service agreement with the Company and uses the Service.
- "Plan" means a goal and action schedule a member registers in the Service.
- A "Solo plan" is a plan a member carries out alone.
- A "Group plan" is a plan several members carry out together.
- "Crew" means members participating in a group plan, and "group-plan admin" means the crew member who runs a group plan.
- "Supporter" means a member who has been invited to, or applied to, cheer on another member's plan.
- "Action" means a dated record a member leaves for a plan, which may include notes, photos, numbers, places and more.
- "Cheer" means likes, cheer messages, stickers, gift deliveries and similar a member leaves on another member's plan or action.
- "Posts" means all information a member uploads to the Service, including text, photos, files, chat messages and action records.
- "Grit" means activity points awarded based on Service usage. Grit is used only for levels and rankings and cannot be exchanged for cash or goods.
- "AI features" means features in which an artificial-intelligence model writes plan advice, check-ups, look-backs, group-plan reports and similar at the member's request. An "AI ticket" means the right to use an AI feature once.
- "Subscription" means a member paying through the App Store or Google Play to use the benefits of a paid tier (Plan Pro, Group Pro, etc.) for a set period.
Article 3 (Posting and Amendment of the Terms)
- The Company posts these Terms in the Service and on the website (zaksimi.com/en/terms) where members can easily see them.
- The Company may amend these Terms within the limits of applicable law.
- When amending these Terms, the Company will announce the effective date and reasons in the Service at least 7 days in advance. Changes that are unfavorable or material to members will be announced at least 30 days in advance and notified individually by in-app notification, email or similar.
- A member who does not agree to the amended Terms may terminate the service agreement (delete their account). If the Company clearly notified members under paragraph 3 that failure to object by the effective date will be deemed acceptance, and a member does not object, the member is deemed to have accepted the amended Terms.
Article 4 (Rules Outside These Terms)
Matters not covered in these Terms are governed by the Telecommunications Business Act, the Act on Promotion of Information and Communications Network Utilization and Information Protection, the Personal Information Protection Act, the Act on Consumer Protection in Electronic Commerce, the Content Industry Promotion Act and other applicable laws, and by operating policies set by the Company.
Chapter 2. Service Agreement
Article 5 (Formation of the Agreement)
- The service agreement is formed when an applicant agrees to these Terms, applies following the Company's procedures, and the Company accepts the application.
- Members can sign up by email verification or with an external account supported by the Company (Google, Apple, Kakao, etc.). An email address can be registered with only one sign-up method.
- The Service is available only to those aged 14 or older. The Company checks age at sign-up using the birth year or similar.
Article 6 (Refusal or Deferral of Applications)
The Company may refuse an application, or later terminate the agreement, if:
- The applicant is under 14;
- The applicant used another person's information or provided false information;
- A member whose use was restricted for violating these Terms tries to sign up again; or
- The application otherwise violates applicable law or these Terms.
Article 7 (Account Management)
- Members must manage their own account and password and must not let third parties use them.
- An account can be signed in on up to 5 devices at the same time, and a device not used for 30 days must sign in again.
- If a member learns their account has been stolen or is being used by a third party, they must change their password immediately (which signs out other devices), notify the Company and follow its guidance.
Article 8 (Changes to Member Information)
Members can view and edit their information in the Service's settings. The birth year can be changed up to 3 times after sign-up.
Article 9 (Account Deletion)
- Members may delete their account at any time from [More > Member info > Delete account] in the app, and the Company processes it immediately. Members who cannot use the app may request deletion from customer support (support@btiwoom.com).
- The admin of a group plan in progress in which other crew members are participating can delete their account only after handing admin rights to another crew member.
- On deletion, the member's personal information and the content they wrote (plans, actions, photos, cheer messages, chat messages, posts, etc.) are deleted in accordance with the Privacy Policy and cannot be recovered. Records left on other members' plans remain, without content, as from a "Deleted member," and other members' stats (action rate, cheers received, etc.) do not change.
- On deletion, Grit, levels and received AI tickets are lost and are not carried over even if the member signs up again.
- Deleting an account does not automatically cancel an App Store or Google Play subscription. Members must cancel their subscription in the store before deleting their account.
Chapter 3. Use of the Service
Article 10 (Service Description)
The Service includes:
- Creating and managing plans (solo and group) and recording actions;
- Inviting supporters, recruiting crew, and searching and applying to public plans;
- Member-to-member features such as cheers, chat, boards and reviews;
- Action stats, progress analysis and AI features;
- Grit levels and rankings;
- Cheer gift delivery;
- Paid subscriptions; and
- Other services the Company develops or provides through partnerships.
Article 11 (Provision and Changes of the Service)
- In principle, the Service is provided 24 hours a day, year-round. It may be suspended temporarily for system maintenance, equipment failure, natural disasters and similar unavoidable circumstances.
- The Company may change all or part of the Service for operational or technical reasons, announcing the changes and effective date in advance. Changes that reduce the benefits of paid tiers are announced 30 days in advance.
- If the Company ends the Service, it will announce this at least 30 days before the end date and allow a reasonable period for members to download their records and original photos. Fees for the remaining subscription period are refunded through the store.
Article 12 (AI Features)
- AI features run only when a member requests them. However, on the Group Pro tier, text the member will use may be prepared in advance. The information needed is transmitted to an AI service provider outside Korea, as described in the Privacy Policy.
- AI results are for reference only. Their accuracy, completeness or fitness for a particular purpose is not guaranteed. For matters requiring professional judgment — medical, legal, financial and the like — always consult a professional.
- The number of times AI features can newly be used is set per period for each tier, and the remaining count is shown on the relevant screen of the app. The Company may change these counts to operate the Service.
Article 13 (AI Tickets)
- Members on a paid tier can send a set number of AI tickets each month, according to their tier, together with a cheer message to connected members such as supporters and crew. Tickets not sent do not carry over to the next month.
- A received AI ticket can be used for advice and plan check-ups for 30 days from the day it is received. There is a limit on how many tickets one member can receive in a month.
- AI tickets have no cash value, cannot be transferred to others for money, and are not refundable.
- If a member's tier is lowered or their subscription is refunded, AI tickets not yet sent are lost. Tickets already sent remain with the members who received them.
Article 14 (Storage)
- Photos, files and original photos a member uploads are kept up to the storage capacity of their tier. Capacity is shown in [More > Storage] in the app.
- When storage is full, the oldest original photos are moved to the trash first and deleted after 30 days. Reduced photos shown in lists and attached files are not deleted automatically; if capacity is still exceeded, new uploads are restricted.
- If a member's tier is lowered, the previous capacity is kept for 30 days, after which it is reduced in the manner described in paragraph 2. The Company notifies the member 7 days and 1 day before the reduction and explains how to download originals.
- Original photos can be downloaded each month up to the member's own storage capacity, and this allowance is refilled on the 1st of each month.
Article 15 (Cheer Gifts)
- Cheer gifts let a member send another member a link to a mobile gift the member bought directly from an outside seller (e.g., Coupang). The Company is not the seller of these products or a party to the transaction.
- Purchase, payment, refunds, use and expiry of the products follow the seller's policies.
- Recipients can decline a gift before opening it, and when they do, can block the sender so they receive no further gifts from them. Senders can cancel a gift before the recipient opens it. A gift not opened within 7 days ends as undelivered.
- Inappropriate gifts can be reported in the Service, and the Company reviews reports and either voids the gift or dismisses the report.
- The Company may temporarily suspend or stop sending for each type of gift. Gifts already sent remain as they are.
- If the Company sells paid products directly in the future, it will separately disclose the transaction terms, withdrawal of offers and other matters required by law, and obtain consent.
Article 16 (Affiliate Products and Disclosure of Economic Interest)
- The Service may include product listings through affiliate programs such as Coupang Partners.
- When a member buys a product through these listings, the Company may receive a commission from the affiliate. The Company discloses this on the relevant screen.
Article 17 (Grit and Levels)
- Grit is a score reflecting Service usage. It cannot be exchanged for cash, products or points of other services, or transferred to other members.
- The Company may set limits on the Grit earned per day and per month. How Grit is earned and its limits are shown on the app's guide screen.
- If a record that earned Grit (an action, post or review) is deleted, or a gift is canceled or declined, that Grit is taken back. The Company may revoke Grit obtained by improper means.
Chapter 4. Posts
Article 18 (Rights to and Use of Posts)
- Copyright in posts a member uploads to the Service belongs to that member.
- The Company may use members' posts free of charge to the extent necessary to operate, display (including format conversion such as reducing photo size) and improve the Service. Use beyond that scope, or use outside the Service such as for promotion, requires the member's prior consent.
- Posts are visible according to the visibility the member sets. Public plans and their action records are visible to all members of the Service. For each board post and review, the member can choose who can read it (only me, crew, everyone). People who receive an invitation link can see a plan summary even if they are not members.
Article 19 (Management of Posts)
- The Company may hide or delete, without prior notice, posts that:
- defame others or invade their privacy;
- are obscene or violent, or encourage self-harm or suicide;
- infringe copyright or other rights of others;
- are commercial advertising or spam; or
- relate to crime or violate the law.
- Group-plan admins may delete posts on the group-plan board and suspend crew members' participation, and chat-room admins may hide chat messages. Group-plan admins must use these powers only to run that space.
- A group-plan admin must hand admin rights to another crew member before leaving a group plan in progress. The handover takes effect only if the receiving crew member accepts within 7 days.
- A person whose rights are infringed may ask the Company to delete or temporarily block a post, and the Company will handle it under the Information and Communications Network Act.
Chapter 5. Paid Services
Article 20 (Subscription Tiers and Fees)
- The benefits of each subscription tier (storage capacity, number of photos, AI usage counts, AI tickets, group-plan management tools, etc.) and fees are shown on the app's subscription screen and in the store before payment. Fees are the prices shown in the store, including VAT.
- The group-plan benefits of the Group Pro tier apply to the group plan the subscribing member chooses, and remain even if the group-plan admin changes.
- When the Company raises fees, it notifies members 30 days in advance through the app and the store, and the subscription of a member who does not agree ends at the next renewal.
- The Company may grant members a paid tier for a set period through events and the like; if this overlaps with a store subscription, the higher tier applies.
Article 21 (Payment and Auto-Renewal)
- Subscriptions are available only through App Store or Google Play payment, and payment, renewal and cancellation follow that store's policies.
- Subscriptions renew automatically for the same period until the member cancels. A tier is applied after the Company confirms the transaction with the store.
- Changing to a higher tier takes effect immediately; changing to a lower tier or a different period takes effect from the next renewal.
- If a renewal payment fails, the tier is kept for the grace period set by the store, after which the member moves to the free tier.
- Moving a subscription to another account (restoring purchases) can be done only once every 30 days, and when it is moved, the previous account's tier ends immediately.
Article 22 (Cancellation)
- Members can cancel at any time in the store's subscription management, and the tier is kept until the end of the period already paid for.
- When a member cancels or their tier is lowered, storage capacity is reduced under Article 14(3), and AI tickets not sent are lost under Article 13(4).
Article 23 (Withdrawal and Refunds)
- A member may withdraw the purchase and receive a full refund within 7 days of payment if they have not used the benefits of the paid tier.
- After using features available only on a paid tier (more AI usage, increased storage capacity, sending AI tickets, etc.), withdrawal may be restricted under Article 17(2) of the E-Commerce Act, and the Company notifies members of this before payment.
- A subscription paid for by a member under 19 without the consent of their legal representative can be canceled by the member or the legal representative, and the Company refunds the full amount.
- Refunds follow the store's procedures. For the App Store, the member requests a refund from Apple (the request screen can be opened from the app); for Google Play, the Company issues the refund. Requests are also accepted through the in-app customer inquiry.
- When a refund is made, the tier ends immediately. AI results already used and photos already uploaded are not taken back.
Chapter 6. Obligations of the Parties
Article 24 (Company Obligations)
- The Company complies with applicable law and these Terms and strives to provide the Service reliably.
- The Company protects members' personal information in accordance with the Privacy Policy.
- The Company receives members' opinions and complaints through the in-app customer inquiry and answers within 5 business days; if they are found to be justified, it handles them without delay. If an inquiry contains urgent expressions, the Company first points the member to counseling services.
Article 25 (Member Obligations)
Members must not:
- Register false information when signing up or changing information;
- Steal another member's account or collect or use personal information without authorization;
- Harass other members or repeatedly send unwanted contact or gifts;
- Upload posts described in Article 19(1);
- Use the Service for commercial purposes, access it by automated means, or interfere with its normal operation;
- Use the Service other than for its intended purpose (such as using chat or records as photo or file storage);
- Obtain Grit, rankings or AI tickets by improper means, or buy or sell them for money;
- Impersonate the Company's employees or operators; or
- Otherwise violate applicable law or these Terms.
Article 26 (Restrictions on Use)
- If a member violates Article 25, the Company may, depending on severity, issue a warning, delete posts, suspend use for a period, or terminate the agreement.
- The Company notifies the member of the reason and duration. The member may object within 14 days of receiving the notice.
Chapter 7. Miscellaneous
Article 27 (Notices to Members)
- The Company notifies members by in-app notification, in-Service announcement, or the email address the member registered.
- Notices to an unspecified number of members may be replaced by an announcement in the Service for at least 7 days.
Article 28 (Limitation of Liability)
- The Company is not liable for damages that occur without its intent or negligence, such as from natural disasters, the member's own fault, or outages of third-party services (external login, stores, maps, AI service providers, sellers, etc.).
- The Company has no obligation to intervene in disputes arising through the Service between members, or between a member and a third party, and is not liable for resulting damages, except where the Company acted intentionally or negligently.
- Unless applicable law provides otherwise, the Company is not liable in connection with use of free services, except in cases of the Company's intent or gross negligence.
Article 29 (Governing Law and Jurisdiction)
These Terms are governed by the laws of the Republic of Korea. Disputes between the Company and a member regarding the Service are resolved by the court with jurisdiction under the Civil Procedure Act.
Addendum
These Terms take effect on [Effective Date].
